**Please read Padbike's terms and conditions carefully. All participants must agree to the terms and conditions to book with us.**

Padbike reserves the right to modify these terms and conditions at any time without prior notice. In the event that changes are made, the new terms and conditions will be immediately posted on our website.

**BOOKING WITH US**

Once Padbike receives an email from you with information on:

the type of holiday package requested or the type of short guided excursion, the number of guests, the dates of the stay with us, alternative dates in case we are fully booked, and a brief description of the participants' skill levels, including the group's riding experience, Padbike will respond to you with availability and provide you with our booking form. Your booking with us will only be confirmed once we have received completed booking forms from all participants.

The services and prices confirmed with the booking apply.

**DEPOSIT**

To confirm the booking, a non-refundable deposit of 30% of the total booking cost per person is required at the time of booking.

 

**BALANCE PAYMENT**

Padbike must receive the final balance payment no later than 21 days before the arrival date of your holiday with us. If we do not receive the balance within this period, or if you have not provided justified evidence to suggest otherwise, we reserve the right to consider your booking as canceled, authorize another booking in your place, and apply the cancellation fee described below.

If you book within 3 weeks of your holiday with us, the full balance will be required once your booking is confirmed.

 

**BOOKING CHANGES**

Padbike will try to accommodate requested changes to the original details provided with the booking; however, if we cannot fulfill such changes and you wish to cancel the holiday, the cancellation fee described below will apply.

**ACCOMMODATION CHANGES**

If, due to force majeure, the booked accommodation is no longer available to host participants of the Mountain Bike tour organized by Padbike, Padbike will arrange new accommodation with the same characteristics.

**CANCELLATION FEES**

In case of cancellation by you, Padbike's cancellation fees are listed below and must be paid by the initial arrival date of your holiday unless the cancellation is due to force majeure:

- 3 or more weeks before the arrival date of your holiday: 20% of the total cost (corresponding to the non-refundable deposit)
- 3 - 2 weeks before the arrival date of your holiday: 60% of the total cost
- Less than 2 weeks before the arrival date of your holiday: 100% of the total cost

**REGISTRATION CLOSING AND MINIMUM NUMBER OF PARTICIPANTS**

The registration closing date is at 9:00 PM, 21 days (3 weeks) before the first day of the tour. At the close of registration, it will be immediately communicated whether the tour has reached the minimum number of participants, which is 4. For the 3-day "Giro dell'Elba in E-MTB" tour, the minimum number of participants is 5.

If the minimum number of participants is not reached, the client will be entitled to one of the following two alternatives:

- A voucher equal to the value of the tour to be used for any tour promoted through the Padbike website.
- A full refund of the amount paid.

**CANCELLATION BY PADBIKE**

In the unlikely event that we have to cancel the bike tour you have booked, we offer a full refund of the payment or alternative dates for your holiday with us, depending on your preference.

**EURO EXCHANGE RATE**

Our prices are in Euro (€), and your holiday with us must be paid in Euro (€). If you book from a country outside the Eurozone, please note that the exchange rate from Euro to your currency may vary from the date of the deposit payment to the final balance due date. Padbike does not offer any monetary compensation for any increases or decreases in total costs caused by exchange rate changes.

**WEATHER**

Although the Mediterranean climate is mild, heavy rains or storms may occur that can affect your holiday and trail riding. Padbike will do its best to deal with different weather conditions; however, to ensure the safety of our customers and staff, Padbike reserves the right to cancel any riding days during your holiday. Additionally, Padbike cannot be held responsible for adverse weather conditions.

If the weather forecast does not allow the activity to be carried out safely, both for the guides and participants, the tour will be canceled. Padbike reserves the full and exclusive right to cancel a tour due to adverse weather conditions.

Padbike reserves the right to inform participants of the imminent cancellation of the tour within 48 hours of the tour date. If Padbike cancels the tour within 48 hours of the start date, participants are entitled to a voucher equal to 70% of the tour value, which can only be used for another Padbike tour on the padbike.com website. The voucher is valid for 1 year (365 days). If the tour is canceled after the 48 hours before the start date, no voucher is provided.

**VEHICLES FOR TRANSPORTATION AND BIKE TRAILERS**

Customers use Padbike vehicles or any external partners' vehicles for transportation and bike trailers entirely at their own risk. Customers are responsible for the safe transportation of their bikes and must ensure that their bikes are securely placed on the trailers. Padbike cannot be held responsible for any damage to customers' bikes during the holiday with us.

**TRANSFERS FROM THE PORT OF PORTOFERRAIO TO THE ACCOMMODATION**

Unlikely events such as vehicle breakdowns, heavy traffic, accidents, adverse weather conditions, or other unforeseen events may delay our shuttle service to the port. Therefore, Padbike cannot guarantee arrival at the port at the scheduled time. Additionally, Padbike cannot be held responsible for any missed ferries under any circumstances, nor will it cover any consequential costs that may occur due to missed ferries and delayed departure.

**CYCLISTS' SAFETY AND RESPONSIBILITY**

Mountain biking is a dangerous sport and carries certain risks. Due to the challenging nature of the trails and the amount of riding that our customers will do during guided mountain bike tours with us, accidents are likely to occur during the ride. Padbike staff will take all precautions to ensure the cyclists' safety; however, Padbike cannot be held responsible for any accidents, injuries, or, in extremely unlikely cases, the death of cyclists during guided tours with us.

Using appropriate safety equipment can reduce the extent of injuries. A proper mountain bike helmet and minimum protection are absolutely essential for a cyclist. Padbike staff reserve the right to refuse to accompany any cyclist who does not wear a helmet and knee protection. For more aggressive downhill riding, it is strongly recommended to use a full-face helmet for greater protection in case of violent falls on the face. Suitable cycling gloves are also recommended to be worn at all times during rides with Padbike staff. As elbow and knee protection has been shown to reduce the potential severity of external injuries and can reduce the likelihood of fractures in accidents, we strongly recommend wearing adequate protection while riding.

Padbike cannot guarantee the safety of every trail. Natural hazards such as fallen trees, landslides, or floods can occur without warning, and Padbike cannot be held responsible for any losses, damages, or injuries caused by such hazards.

**ACCIDENTS AND FIRST AID**

All Padbike staff are equipped with a basic first aid kit and local emergency contacts in the event of an accident. In the event of an accident, our staff will act according to their knowledge and experience; however, they are not qualified medical professionals. If you do not wish to be treated by Padbike staff and prefer to wait for trained professionals to arrive at the accident scene, please inform us immediately.

**APPLICABLE LAW**

These terms and conditions are subject to Italian law, and any disputes that may arise will be subject to the exclusive jurisdiction of the Italian courts.

**ACCEPTANCE OF TERMS AND CONDITIONS**

Booking your stays with Padbike implies acceptance of all the above-mentioned terms and conditions. Please make sure to read and fully understand all the provisions before making a booking.
